Una notizia destinata a far scalpore: il diritto all’assegno di mantenimento in favore delle coppie dello stesso sesso. I riferimenti legislativi. La prima sezione della Corte di Cassazione, con l’ordinanza n. 2507 del 07 Gennaio 2023 ha disposto la trasmissione degli atti al Primo Presidente per l’eventuale assegnazione alle Sezioni Unite per la soluzione dei seguenti quesiti:
• E’ possibile riconoscere alle coppie dello stesso sesso l’assegno di mantenimento?
• E’ possibile riconoscere alle coppie dello stesso sesso l’assegno divorzile?
Prima di rispondere a questa domanda bisogna necessariamente fare un passo indietro.
Bisogna ricordare la Legge Cirinnà, e le previsioni ivi contenute, relativamente al contratto di convivenza, alle unioni civili nonché alla semplice convivenza more uxorio.
A ciò si aggiunga che bisogna necessariamente fare riferimento anche alla Legge sul divorzio del 1 Dicembre 1970 n. 898.
In particolare l’art.5, comma 6, della Legge sul divorzio stabilisce che con la sentenza che pronuncia lo scioglimento o la cessazione degli effetti civili del matrimonio il Tribunale, tenendo conto di tutta una serie di condizioni, dispone l’obbligo per un coniuge di somministrare periodicamente a favore dell’altro un assegno quando lo stesso non ha mezzi adeguati o non se li può procurare per ragioni oggettive.
La legge Cirinnà, Legge 20 Maggio 2016 n. 76, ha permesso l’unione civile tra persone dello stesso sesso ed ha, quindi, almeno su questo punto creato una parità di diritti tra le coppie omosessuali e le coppie eterosessuali.
La vicenda processuale.
L’ordinanza della Corte di Cassazione trova il suo fondamento nel caso di separazione di due donne.
Una coppia che aveva iniziato il proprio legame molto prima del 2016 e, quindi, in un momento in cui non avrebbero potuto né convolare a nozze né instaurare una convivenza riconosciuta dalla Legge.
Naufragato il matrimonio uno dei coniugi richiedeva che l’altro coniuge versasse a suo favore l’assegno divorzile.
La richiesta veniva avanzata in virtù dei sacrifici fatti, della rinuncia alla carriera, al trasferimento in un’altra città per il bene della famiglia e molto altro.
Pronunciandosi sullo scioglimento dell’unione civile, il Tribunale aveva disposto la corresponsione di un assegno assistenziale pari ad euro 550,00 mensili.
La decisione veniva però riformata in secondo grado.
Infatti la Corte d’Appello riteneva insussistente il diritto all’assegno divorzile poiché le circostanze allegate dalla richiedente a sostegno della propria pretesa erano antecedenti rispetto all’entrata in vigore della Legge Cirinnà nel 2016.
Vistosi negare l’assegno di mantenimento il coniuge faceva ricorso alla Cassazione per la decisione di merito.
La decisione della Corte di Cassazione.
La Suprema Corte, riconosciuta la rilevanza della questione, ha disposto la trasmissione degli atti al Primo Presidente per l’eventuale assegnazione alle Sezioni Unite per la soluzione del quesito secondo cui debbano essere valutati i fatti intercorsi tra le parti anteriori alla costituzione dell’unione civile oppure no.
Secondo la Suprema Corte di Cassazione, la decisione della Corte d’Appello che sostiene la non rilevanza dei fatti avvenuti prima dell’unione civile rischia di contrastare con la Convenzione Europea dei Diritti dell’Uomo come interpretata dai Giudici di Strasburgo.
Si tratta di fatti molto importanti con possibili conseguenze della decisione su altre controversie simili in futuro ma soprattutto di argomenti che interessano la collettività e le coscienze sociali.
Vedremo come le Sezioni Unite si esprimeranno.
Il parere dell’esperto.
E’ difficile prevedere quale sarà la decisione della Corte di Cassazione ma, stante il carico di lavoro, sicuramente ci vorrà del tempo.
Correttamente la Corte di Cassazione ha evidenziato una forma di discriminazione nonché la violazione della Convenzione Europea dei Diritti dell’Uomo.
Ma occorre chiedersi se la ragione di questa violazione sia stata espressa chiaramente.
A mio parere NO.
La Corte di Cassazione avrebbe dovuto, per consentire anche una decisione ben ponderata, sottolineare che nel caso di specie l’aver convissuto a lungo non era una scelta ma un obbligo.
Semplicemente alle coppie omosessuali era negato il diritto di creare una famiglia.
Pertanto è giusto che ancora una volta si debba pagare il dazio di una scelta fatta da altri?
Vedendo la questione solo da questo punto di vista la risposta è ovviamente no.
Ma….( si tratta di un grosso Ma).
Il riconoscere valore alla convivenza significherebbe rimettere in discussione tutta la giurisprudenza formatasi sul punto, si parla ovviamente di giudizi riguardanti coppie eterosessuali, poiché il periodo di convivenza non viene riconosciuto come periodo valido ai fini della quantificazione dell’assegno di mantenimento.
La Corte di Cassazione, quindi, dovrebbe riconoscere la legittimità del calcolo del periodo di convivenza sia nei rapporti omosessuali che in quelli eterosessuali.
Il quesito finale è: La Corte di Cassazione si assumerà questa responsabilità?
