L’Amministrazione di Anghiari mostra di basare le proprie competenze riguardo al piano antenne su esperti in discipline olistiche, yoga Kundalini e “Stop 5G”. A quando il terrapiattismo? Oggi è un grande giorno, veramente: abbiamo avuto l’onore di un commento ad un nostro post da parte del Vicesindaco Claudio Maggini, che conferma in questo modo la sua fama di essere il membro più attivo e maggiormente desideroso di risolvere i problemi dei cittadini tra tutti quelli presenti nell’amministrazione di Anghiari. (Si noti il nostro “abbraccio” nell’illustrazione…)
L’interazione è stata breve, ma significativa: l’assessore ci ha trasmesso il link ad un articolo, dove si sostiene l’inutilità per un Comune di dotarsi di un piano antenne. Nessun testo lo accompagna, ma l’unica interpretazione possibile – ci sembra – sia che il Vicesindaco voglia segnalarci che bene ha fatto il Comune di Anghiari a NON dotarsi di un “piano antenne”, come invece gli viene contestato, poiché sarebbe stato solo inutile e dispendioso. Cerchiamo dunque di analizzare questo importante contributo, che, per essere stato citato direttamente, senza dubbio riflette in modo netto il pensiero dell’Amministrazione e deve aver determinato il suo comportamento in tutta questa vicenda. Chiariamo innanzitutto cosa siano i “piani antenne”: essi sono strumenti previsti dalla legge 39/2001 (“Legge quadro sulla protezione dalle esposizioni a campi elettrici, magnetici ed elettromagnetici”) che all’articolo 8 comma 6 recita: “I comuni possono adottare un regolamento […] per assicurare il corretto insediamento urbanistico e territoriale degli impianti e minimizzare l’esposizione della popolazione ai campi elettromagnetici …”. In sostanza, il “piano antenne” permette al Comune di stabilire dove mettere le antenne e dunque cercare di fermare lo strapotere delle compagnie telefoniche. I nostri vicini di Arezzo, Sansepolcro e Città di Castello ad esempio ce l’hanno e basta fare una minima ricerca in rete per trovarne innumerevoli in innumerevoli comuni italiani. Il Comune di Anghiari però questo piano non ce l’ha. Non per una mancanza dell’Amministrazione, sosterrebbe però Maggini, ma anzi per una sua maggiore lungimiranza, come si vedrebbe dimostrato nell’articolo di cui ci ha offerto il link. Cosa dice allora di così tanto determinante questo articolo? Leggetelo, ma ve lo sintetizziamo in: i piani antenne sono costosi e inutili poiché non possono fermare lo strapotere delle grandi aziende, le quali vincono nei ricorsi giudiziari e rendono il Sindaco di fatto impotente. Sarà vero? Proprio no, basta vedere una *estrema* sintesi tra le moltissime sentenze disponibili, che hanno tutte confermato l’efficacia di questo strumento:
– Corte Suprema di Cassazione Sez. III n. 722, 21 marzo 2013 (se un Comune ha un Piano Antenne tecnicamente valido può imporre delocalizzazioni di impianti, e impedire che su quelli esistenti arrivino altri gestori o altre tecnologie, se queste non sono previste nel piano stesso)
– TAR Toscana n. 1675 del 5 dicembre 2013 (Comune di Arezzo) (l’autorizzazione deve garantire la coerenza dell’intervento rispetto allo strumento di pianificazione)
– TAR Toscana n. 434 del 26 luglio 2018 (Comune di Lucca) (in presenza di piano antenne il gestore non può scegliere il luogo che preferisce poiché più a lui conveniente)
– Ricorso straordinario al Presidente della Repubblica (21 giugno 2019) (il Presidente respinge il ricorso di un gestore contro il piano antenne di Peccioli, PI)
– Sentenza TAR Marche n. 131 del 7 febbraio 2024 (contro, guarda caso, Inwit SpA) (il gestore non può opporsi al piano antenne del Comune contestando il posizionamento ottimale del palo in funzione della copertura della rete di telefonia mobile).
Ma perché l’articolo allora si sbaglia in modo così plateale?
Perchè il testo (tra l’altro risalente al preistorico 5/2/21 e apparso su di un sito che si occupa tra l’altro di Oroscopo, Aristogatti e della cronaca di Ladispoli e Cerveteri) è a firma di tale Maurizio Martucci, che risulta essere il fondatore del movimento “Stop 5G” e conosciuto ai siti che asseriscono di voler stanare gli spargitori di bufale (ad esempio https://www.butac.it/tag/maurizio-martucci/). Coerentemente con il suo pensiero, il signor Martucci NON fa un’analisi critica della situazione giuridica, bensì cavalca una sola sentenza sfavorevole (contro il piano antenne della giunta Marino a Roma poiché mal realizzato) per portare avanti a spada tratta le tesi degli oppositori al 5G con la richiesta di maggiori strumenti legislativi per fermarne l’avanzata. Con tutto il rispetto per chi porta avanti tali battaglie, la nostra opposizione all’antenna è però sempre stata basata su di un approccio scientifico e non ideologico, come si potrà riscontrare nei nostri post e comunicati stampa. Ci stupisce allora verificare che il pensiero giuridico-scientifico dei nostri Amministratori venga invece a fondarsi su tesi pubblicate non su riviste accademiche bensì nella (con tutto il rispetto) “cronaca del pagliaio” di Cerveteri, da parte di un rispettabilissimo autore nel suo genere che ha però un approccio alla realtà non esattamente scientifico (dato che, sue parole: “si nutre esclusivamente di alimenti vegani e biologici. Cultore di discipline olistiche e tradizioni millenarie, pratica Kundalini Yoga unito al sentiero spirituale dei popoli nativi, in simbiosi con la natura”), che non ha nessuna – come lui stesso dichiara nel suo curriculum – competenza giuridica e non si è di certo preso la briga di verificare se ci fossero sentenze positive emesse da corti italiane poiché troppo intento a dimostrare che senza una legge apposita ci troveremo il 5G anche in bagno. Tutto legittimo, ma se questa è la fonte di conoscenza sottostante alle decisioni comunali, ci auguriamo che non si inizino a frequentare siti terrapiattisti, poiché dovremo temere serie conseguenze per il piano regolatore…
Cosa possiamo allora ricavare da questo contributo?
Innanzitutto che ribadiamo il nostro grande apprezzamento per l’interazione offerta dall’assessore Maggini, che speriamo possa continuare e ci auguriamo che il Vicesindaco possa diventare per i cittadini l’interlocutore di riferimento su questo ed altri problemi. Dobbiamo però constatare che, oggettivamente, se questo è tutto ciò che l’Amministrazione è in grado di fare, è davvero un po’ poco, e poco stupisce allora se siamo arrivati a questo punto. Dobbiamo però anche riconoscere che ciò costituisca una parziale discolpa dei nostri amministratori. Perché? Poiché conferma pienamente la nostra benigna ipotesi (che abbiamo sempre propugnato contro altre molto più malevoli che si odono in giro) che, molto semplicemente, il Comune non abbia proprio idea di ciò di cui si parla. Ci siamo però sbagliati anche noi. Infatti, durante il Consiglio Comunale del 6/3 il Sindaco ostentò e automagnificò così tanto le sue capacità amministrative e legali, che decidemmo di confidare in lui la nostra piena fiducia sul fatto che sarebbe arrivato ad un risultato positivo nel contraddittorio con Inwit. Ora, dopo questo e dopo tutte le nostre inutili sollecitazioni di maggior chiarezza, iniziamo seriamente a dubitare che tutte le sue ostentate conoscenze legali fossero soltanto indirizzate a proteggere sé stesso dalle responsabilità che potranno attenderlo alla fine di questo percorso. Se così stanno le cose, se questo è il livello di competenza che caratterizza l’amministrazione di Alessandro Polcri, forse sarebbe il caso che quest’ultimo cedesse il potere di interagire con Inwit SpA a qualcuno maggiormente in grado di farlo o decidesse alfine di unire in questa attività altri membri del Consiglio con maggiore capacità o esperienza politica.
E’ il caso di parlarne, seriamente, prima che sia troppo tardi, dato che per noi non conta il primeggiare nell’agone politico, ma soltanto il risultato. Continuiamo però ad essere una vox clamantis in deserto.
