Antitrust ha aperto un’istruttoria nei confronti di Intesa SanPaolo per pratica commerciale scorretta (1): migliaia di utenti sarebbero stati impropriamente trasferiti al servizio esclusivamente digitale ad una sua banca del gruppo, Isybank

Sono arrivate all’Aduc varie segnalazioni che confermano la “allegra” comunicazione di trasferimento (senza alcuna scelta) di coloro che la Banca Intesa San Paolo ha unilateralmente e apoditticamente valutato come utenti esclusivamente digitali (Isybank s.p.a. è esclusivamente banca digitale e prevede solo l’utilizzo di smartphone e non da browser). Non è ancora noto il numero oggettivo di questi utenti ma possiamo valutarli in diverse decine di migliaia che, informati in un periodo di basso uso del servizio (i messaggi sono infatti arrivati durante l’estate), si sono poi ritrovati loto malgrado utenti del solo servizio smartphone. E’ fondamentale ricordare che se un utente decide di comunicare variazioni importati alla banca, quest’ultima accetta solo comunicazioni che possono essere tracciate (raccomandata A/R, pec o presenza)…; non si capisce perché il medesimo sistema non debba essere adottato dalla banca (con l’eventuale eccezione di chi ha deliberatamente scelto di ricevere comunicazioni in modo diverso). Da qui, la legittimità dell’apertura di un’istruttoria che auspichiamo, sanzioni la banca e le imponga di informare gli utenti in modo tracciabile rimettendo gli stessi in termini per la comunicazione all’Istituto di Credito di accettazione o meno del trasferimento.
Intesa San Paolo non può essere al di sopra degli abituali sistemi di garanzia imposti dalle norme.
