La decisione della Corte d’Appello su Olindo Romano e Rosa Bazzi Via libera al processo di revisione per la strage di Erba per cui sono stati condannati all’ergastolo i coniugi Rosa Bazzi e Olindo Romano La Corte d’Appello di Brescia ha emesso un decreto di citazione a giudizio nei confronti di Olindo Romano e Rosa Bazzi per la prima udienza del processo di revisione sulla strage di Erba.
L’udienza è fissata per il primo marzo davanti alla seconda sezione penale, come reso noto da uno dei legali della coppia, Fabio Schembri. Tre gli esiti possibili: il processo si potrà concludere con un’assoluzione o una condanna di Rosa Bazzi e Olindo Romano oppure con una dichiarazione di inammissibilità dell’istanza di revisione.
La strage di Erba
Si riapre dunque il caso dell’omicidio plurimo avvenuto il 11 dicembre 2006 ad Erba, in provincia di Como, per cui i due coniugi furono accusati e condannati all’ergastolo nel primo processo: carcere a vita per aver ucciso a colpi di coltello e spranga Raffaella Castagna, il figlio Youssef Marzouk, e la madre Paola Galli e infine la vicina di casa Valeria Cherubini. Il marito di quest’ultima, Mario Frigerio, fu colpito da una coltellata alla gola e creduto morto dai killer. A salvarlo fu in realtà una malformazione congenita alla carotide che gli evitò la morte per dissanguamento. La strage avvenne nell’abitazione di Raffaella Castagna, in una corte ristrutturata nel centro della cittadina. L’appartamento fu dato alle fiamme subito dopo. Strage di Erba, parla il giudice Tarfusser: “Se non avessi chiesto la revisione non potrei dormire”
La richiesta di revisione per Rosa e Olindo
L’avvocato Schembri recentemente ha fatto sapere che la richiesta di revisione della condanna per i suoi clienti sarebbe corredata da “nuovi elementi” per la riapertura del caso. “Sulla revisione – ha scritto Romano alla trasmissione Tv – incrocio le dita. Il mio futuro è con Rosa fuori dal carcere”. Secondo il legale la consulenza energetica in possesso dei legali dimostra che prima della strage “vi era qualcuno a casa Castagna”. “Luca, Tv e altri elettrodomestici erano accesi due ore dopo che Raffaella Castagna era uscita”.
Quali sono i nuovi elementi per la riapertura del processo
Nello specifico tra i nuovi elementi di cui parla il legale dei Romano, ci sono le modalità del decesso di Valeria Cherubini che sarebbero “incompatibili” con la tesi di colpevolezza dei coniugi; messa in discussione poi la testimonianza di Frigerio diventato principale testimone dell’accusa che in aula disse di riconoscere Olindo come autore del massacro. Una versione che, per i legali, contrasterebbe con quanto dichiarato dall’uomo (morto negli anni successivi) nell’immediatezza, nel letto d’ospedale, e emerso attraverso le intercettazioni ambientali. Vi è poi un’analisi sull’energia elettrica nell’abitazione della strage e infine la testimonianza di Abdi Kais, mai sentito dagli investigatori, e residente nell’abitazione di Erba, che venne poi arrestato per spaccio nella zona dove avvenne il massacro.
