No controlli sotto il limite di 50 Kmh – E’ stato pubblicato in Gazzetta Ufficiale il cosiddetto “decreto autovelox”, nuove norme su installazione e utilizzo dei misuratori elettronici della velocità sulle strade (1).
Il decreto che riguarda diversi punti: dalle nuove regole per i neopatentati, alla stretta sull’uso dei cellulari alla guida, dai bollini Alcolock ai nuovi obblighi per chi viaggia in monopattino (casco, assicurazione, indicatori di direzione…)
La novità più rilevata è il divieto di installare autovelox sotto i 50 Kmh nei centri abitati. “La postazione fissa può essere collocata esclusivamente se il limite massimo di velocità consentito è pari a quello generalizzato per quel tipo di strada, comunque non inferiore a 50 km/h”.
E’ praticamente la reazione del governo alle amministrazioni che hanno adottato il modello “città 30” (2). I controlli saranno possibili solo con una pattuglia di vigili davanti a scuole ed ospedali.
Strade extraurbane
Potranno essere installati autovelox dove il limite è inferiore di oltre 20 Km a quello previsto dal Codice della strada. Per esempio: se in una strada provinciale c’è il limite dei 90 Km/h si potranno installare autovelox per rilevare multe a chi supera i 70 Km/h.
Segnalazione autovelox
Le installazioni dovranno essere segnalate almeno 1.000 metri sulle strade extraurbane, 200 sulle urbane a scorrimento e 75 sulle altre strade. Fuori dai centri abitati ci, dovrà esserci almeno 1 km di distanza tra il cartello stradale che indica il limite di velocità e l’autovelox. Sulle strade urbane la distanza minima tra due installazioni deve essere di almeno 500 metri.
Il lasciapassare del Prefetto I Comuni, per l’installazione, hanno l’obbligo di avere il nulla osta da parte del Prefetto, dovendo dimostrare che servono a limitare gli incidenti dovuti alla velocità.
Autovelox sulle auto dei vigili Gli autovelox sulle auto dei vigili, che dovranno adeguatamente essere riconoscibili, sono possibili solo se su quel tratto di strada non è possibile collocare postazioni fisse o mobili.
Mancanza di omologazione? Non prevista
Il decreto approvato lascia irrisolto il problema ribadito da una recente sentenza di Cassazione che ha ritenuto non valide le multe comminate da apparecchi non omologati (omologazione impossibile visto che mancano i decreti specifici: la legge a suo tempo lo prevedeva, ma niente è stato fatto) (3).
