Ben otto segnalazioni nel giro di tre giorni, sono tante. Sono quelle di consumatori che, dopo aver visto un qualche video di cosiddetti influencer che – a nostro avviso, dopo averli visionati anche noi – sono macchiette scurrili di se stessi su argomenti vari, hanno criticato gli stessi (talvolta con parole poco “urbane”) e, a seguito, ricevuto da avvocati di questi influencer richieste di indennizzi monetari per diffamazione, con minacce di procedimenti giudiziari se non dovessero adempiere.

Otto segnalazioni sono tante, considerato anche che Aduc è una delle tante associazioni di consumatori, e considerato che mediamente per cose del genere (la diffamazione è un reato penale e non civile) le persone si rivolgono ad un avvocato.

E’ bene, comunque, fare chiarezza e mettere alcuni punti fermi.

Queste pretese sono arrivate tutte per posta ordinaria. Quindi, non essendo posta tracciabile (pec o raccomandata A/R) non hanno valore giuridico. E’ come se uno avesse trovato un volantino pubblicitario nella cassetta della posta.
E’ evidente che, risalendo grazie agli IP (Internet Protocol: etichetta numerica che identifica univocamente un dispositivo su una rete) dei navigatori ai loro indirizzi con cui si sono registrati su questo o quell’altro social, questi influencer (in accordo con loro legali) inviano queste richieste a chiunque dica loro qualcosa che abbia una vaga sembianza di diffamazione. E inviano tramite posta ordinaria (a anche mail) perchè altrimenti, non essendo certi di aver ragione ma facendo solo un tentativo “sparando nel mucchio”, dovrebbero spendere tanti soldi che, probabilmente, non vedrebbero ritornare… oltre ad esporsi a chi, più agguerrito, potrebbe denunciare loro stessi per averli ingiustamente accusati di aver commesso un reato,
Tra i tanti, alla fine, qualcuno “abboccherà”, spinto anche dalla pretesa modesta di indennizzo (in genere un paio di migliaia di euro) che spingerà i più timorosi quanto disinformati (quanti chiamano un’Aduc o un avvocato…?) a levarsi il pensiero pagando quanto richiesto. In genere, per reati come diffamazione, le pretese di indennizzo economico sono di tutt’altra dimensione. Per cui, chiunque dovesse incappare, il consiglio è di non rispondere e non interloquire in nessun modo, anche ad eventuali sollecitazioni via mail o telefono. Solo se e quando si dovesse ricevere una pretesa via posta tracciabile (raccomandata A/R o pec), è bene mettersi in contatto con un’Aduc o un legale per valutare la specifica pretesa e articolare una risposta
