Milano PER L’ASSENZA DI VALUTAZIONE AMBIENTALE STRATEGICA Accolto il ricorso delle associazioni di protezione ambientale, tra cui il Cai«Importante risultato per la salvaguardia del Parco Nazionale dello Stelvio» Il Consiglio di Stato ha dato ragione alle associazioni di protezione ambientale: la realizzazione del nuovo impianto sciistico di Solda (BZ) è incompatibile con i valori naturalistici e paesaggistici tutelati dal Parco Nazionale dello Stelvio.
Nove associazioni di protezione ambientale (Club Alpino Italiano Regione Lombardia, Fai, Federazione Pro Natura, Italia Nostra, Legambiente, Lipu, Mountain Wilderness, Touring Club Italiano, WWF) hanno presentato appello nel giugno 2020 alla sentenza del Tar n. 55/2020 della Provincia Autonoma di Bolzano che riteneva infondato il ricorso contro la Delibera di Giunta n. 106/2018 della Provincia Autonoma di Bolzano.La Delibera aveva dato il via all’iter autorizzativo per realizzare un nuovo impianto di risalita di 1310 metri di lunghezza e una nuova pista a Solda, in un’area di 4,47 ettari nel comune di Stelvio (BZ), in pieno Parco Nazionale dello Stelvio, a completamento del grande carosello sciistico “Ortler-Ronda”, tramite la realizzazione di impianti, con una portata di 550 persone all’ora, non rispettando gli impegni assunti (Intesa dell’11/2/2015 e Linee Guida del 19/1/2017) con la Regione Lombardia, la Provincia Autonoma di Trento e il Ministero dell’Ambiente e la normativa vigente (D.lgs. 14/2016). La Delibera della Giunta provinciale di Bolzano, osservavano le associazioni, non teneva in alcun conto il dovere di tutela degli alti valori naturalistici dei siti Natura 2000 “Ortler Madatschspitze” e “Ulten Sulden”, tutelati dall’Europa e caratterizzati dalla presenza di sei differenti habitat, otto specie faunistiche elencate nella Lista Rossa delle specie animali minacciate in Alto Adige e, infine, di aree di importanza paesaggistica e naturalistica, dove si riproduce la pernice bianca e si registra la presenza dell’aquila reale e del gipeto. La sentenza del Consiglio di Stato di ieri, che ha accolto il ricorso in appello delle associazioni, annulla gli atti impugnati e condanna la Provincia Autonoma di Bolzano e le Funivie Solda al pagamento in solido delle spese del doppio grado di giudizio (quantificate in 8mila euro).
Nella sentenza si legge che l’intervento dell’Ortler-Ronda, incidente in una zona di protezione speciale (tutelata dall’Europa), avrebbe dovuto essere sottoposto, al contrario di quanto avvenuto, in assenza di un piano e di un regolamento del Parco Nazionale dello Stelvio,a Valutazione Ambientale Strategica per accertare il rispetto dei valori paesaggistici e ambientali del territorio.
