La Presidenza dell’Assemblea degli Stati Parte della Corte internazionale, l’organo di controllo gestionale della Corte, ha dichiarato in un comunicato di “deplorare questi atti di intimidazione e i tentativi inaccettabili di minare il mandato della Corte penale internazionale di indagare, sanzionare e prevenire la commissione dei più gravi crimini internazionali”. Il ministero dell’Interno di Mosca ha annunciato infatti l’iscrizione del procuratore Khan e di altri tre giudici nella lista delle “persone ricercate” per aver emesso un “arresto mandato illegale” contro il presidente russo Vladimir Putin. Sia Khan che i magistrati che si occupano del caso e hanno convalidato la richiesta d’arresto per Putin (Tomoko Akane, Rosario Aitala e Sergio Gerardo Ugalde Godinez), sono accusati da Mosca per avere agito “senza motivi di responsabilità penale” contro un capo di stato il cui paese non riconosce lo Statuto di Roma che funge da base per la Corte penale internazionale (CPI).
Putin è indagato dall’Aja insieme al Commissario per i diritti dell’infanzia, Maria Lvova-Belova, per il caso delle deportazioni di minori ucraini in Russia. In un comunicato citato dall’agenzia Interfax, il mistero dell’Interno russo sostiene che “i capi di stato godono dell’assoluta immunità dalla giurisdizione di stati stranieri”. Una affermazione in realtà inesistente, in questa forma, nel diritto internazionale, che contempla la punibilità dei capi si stato e di governo quando commettano crimini di guerra e crimini contro i diritti umani così come riconosciuti dai protocolli della Convenzione di Ginevra
