Accade spesso al consumatore di ritrovarsi una fornitura di energia o gas mai richiesta. Generalmente se ne accorge quando riceve una lettera di “benvenuto” da parte del nuovo fornitore, o comunque la prima bolletta dopo l’attivazione dell’utenza non richiesta. La gran parte di questi contratti derivano da un’offerta ricevuta per telefono o tramite visita del venditore a domicilio.
Le modalità con cui i venditori riescono ad attivare un contratto di fornitura di energia senza che l’utente ne sia a conoscenza sono molteplici: dalle firme false, alle registrazioni vocali false, fino a venditori che si presentano come rappresentanti dell’attuale gestore del consumatore, salvo poi far firmare al malcapitato il contratto di un altro gestore. A volte è sufficiente pronunciare la sillaba “sì” durante la telefonata, ed il venditore la considererà come consenso all’attivazione della nuova fornitura. Ci sono stati anche molti casi in cui il venditore ha attivato contratti senza neanche telefonare o visitare il consumatore. In alcune città, interi quartieri sono passati ad un nuovo gestore senza il consenso di alcuno.
Di seguito, le cautele prima di sottoscrivere un contratto:
1. mai fare contratti per telefono! Se si riceve un’offerta per telefono, buttare giù immediatamente;
2. assicurarsi di non accettare mai niente prima di aver ricevuto e letto per intero le condizioni economiche dell’offerta e le condizioni contrattuali. Dopo aver letto, se avete ancora dubbi, non accettate né sottoscrivete niente.
Tuttavia, qualora ci fosse illecitamente attivato un contratto non richiesto, è necessario difendersi come segue:
1. inviare una raccomandata a/r o PEC al fornitore che ha illecitamente attivato l’offerta, disconoscendo il contratto e chiedendo il ripristino in esenzione spese della precedente fornitura. Come prevede la delibera dell’Arera 06 aprile 2017 n. 228/2017/R/com, è il gestore che ha usurpato l’utenza a dover contattare il precedente fornitore al fine di ripristinare l’utenza cessata.
2. nella lettera di reclamo, chiedere anche copia del contratto in base al quale hanno illecitamente attivato l’utenza. Il contratto falso, infatti, è importante per poter fare una querela per truffa all’Autorità giudiziaria
3. in ogni caso, se il contratto scritto non corrisponde a ciò che è stato pubblicizzato per telefono o durante la visita a domicilio, fare una denuncia per pratica commerciale scorretta all’Antitrust.
Infine, è bene sapere che se il contratto non è stato richiesto, ovvero non è stato correttamente sottoscritto dal consumatore, quest’ultimo non dovrà pagare i consumi al fornitore subentrato illecitamente. Energia gratuita, quindi.
