Poco prima del cenone di fine anno hanno arrestato, a Roma,l’ex ministro e sindaco Gianni Alemanno. Credo che poche persone come lui, in Italia, siano più distanti dai miei valori e dalla mia idea di politica. Eppure questa storia mi ha colpito. Credo sia venuto il momento di pensare che se non si reagisce a queste tipologie di arresto la scala valoriale in cui siamo immersi e di cui siamo felici a nulla serva.
Il reato da lui compiuto riguarda la mancata osservazione del decreto di affidamento ai servizi sociali: una forma “moderata” di esecuzione della pena esterna, decisa al posto dei ventidue mesi di carcerre a cui era stato condannato per traffico di influenze (uno di quei reati che è difficile da capire persino per un giurista con i controfiocchi). Fra l’altro: la responsabile del centro -la nota suor paola- a cui era affidato avrebbe dichiarato che a lei non risulta alcuna assenza dal posto di esecuzione della pena. Dato per accertato il reato e saltata ogni discussione su tutto l’iter di accertamento processuale dello stesso, una cosa però balza subito agli occhi: c’era davvero l’urgenza di impedirgli di continuare nel reato ed arrestarlo la sera del 31 dicembre mentre stava andando alla cena con amici e parenti? Era proprio necesario eseguire subito quell’ordine di cattura e rovinare a lui, ai suoi figli, ai suoi amici, al suo avvocato, agli agenti di PG che sono andati a prenderlo e alle guardie carcerarie un momento simbolico di festa e amicizia? Se quell’arresto lo si fosse eseguito il 2 gennaio, il mondo avrebbe risentito irrimediabilmente di quella decisione: c’era davvero un pericolo immediato nel lasciare libero per due giorni l’ex sindaco di Roma? La galera è davvero l’unico mezzo che la giustizia del XXI secolo ha per correggere condotte amministrativamente sanzionabili?
Davvero ci piace così tanto una giustizia che non sappia distinguere fra un criminale indefesso e pericoloso e un “furbetto”?
