Antitrust ha sanzionato (1) per 900mila euro (cifra decisamente modesta) un operatore energetico, Servizio Energetico nazionale (2) (da non confondere con Servizio elettrico nazionale, il gestore Enel di maggior tutela), per aver attivato contratti a go-go senza l’esplicito consenso da parte del consumatore.
Niente di nuovo. Colpisce perché siamo in periodo di primi passi per il mercato libero del gas e verso la conclusione (fine giugno) del mercato tutelato elettrico. E colpisce anche per il limitato importo che, anche la più piccola delle aziende, facendo due conti, sarebbe disponibile a pagare perché i ricavi per i contratti fatti in violazione della legge sarebbero maggiori della multa.
Questo è e rimane uno dei problemi dell’Antitrust: importi delle multe che non scoraggiano i comportamenti illegali. Quando e se il Parlamento se ne occuperà…. non sarà mai troppo tardi…. Questa multina ci deve anche far alzare le antenne perchè, in questo momento in particolare per il mercato elettrico, i consumatori continuano ad essere subissati di stimoli più o meno aggressivi quanto invasivi della privacy per scegliere un nuovo operatore. Per chi non è ancora nel mercato libero – il 20% degli utenti al netto dei soggetti deboli che comunque restano – se vogliono – nel mercato tutelato – è una sorta di lotta quotidiana tra telefonate e venditori in presenza. Se non si hanno le idee chiare, è bene ricordare che ci sono tre anni di tempo per decidere, ché nel frattempo si viene parcheggiati in un mercato di transito, gestito dall’Autorità Arera, con tariffe fisse e che – verificare sempre – non è detto che siano migliori di quelle del mercato libero.
La sanzione odierna dell’Antitrust ha comunque un aspetto positivo: conviene denunciare all’autorità tutti gli illeciti, ché alla fine forse questi delinquentelli capiranno come si vive in una società civile.
