Ricorsi contro banche. Limiti e difficoltà dell’Abf

Bankitalia ha reso nota l’attività dell’Arbitro bancario Finanziario (ABF) durante il 2024 (1). Strumento importante per la definizione dei contenziosi tra utenti e istituti finanziari che, nel 2024, ha registrato 14mila ricorsi. Se consideriamo la frequenza di problematiche bancarie che vengono sottoposte alla consulenza della nostra associazione (una tra le tante), il numero di ricorrenti ci pare contenuto, anche perché è rarissimo che la banca, dopo il primo tentativo di risoluzione bonaria delle problematiche che le vengono sottoposte, dia ragione all’utente.


Comunque i dati sono questi e siamo soddisfatti che le decisioni dell’Abf vengano poi rispettate dal 96%. Rimane però un problema perché l’Abf possa essere considerato organismo extragiudiziale a tutti gli effetti: che le decisioni debbano essere rispettate e non accettate da parte delle banche. L’attuale norma, infatti, prevede che, in caso di responso negativo per esse, le banche possono decidere se accettare o meno la decisione (pena l’iscrizione in un lista di banche che non accettano). Il passo successivo per l’utente è di rivolgersi al giudice ordinario. Sicuramente forte della pronuncia dell’Abf, ma con spese di giudizio che, nel caso di importi superiore ai 1.100 euro per i quali si può andare dal giudice di pace senza legale, cpossono essere anche superiori agli importi per i quali si è fatto ricorso. Situazione che, di fatto, consente alle banche, che in genere si presentano in giudizio con fior fiore di legali, di avere una sproporzione nei confronti del ricorrente (ci immaginiamo, per esempio, due avvocati dal giudice di pace contro il ricorrente da solo senza
legale… premessa di un “massacro” a meno di palesi violazioni che anche il più sguarnito utente in materia di diritto possa contrastare). Crediamo che il legislatore dovrebbe modificare l’attuale meccanismo, sì che le decisioni dell’Abf abbiano valore certo e definitivo, come avviene per altri contenziosi in materia di energia (Autorità Arera) e telecomunicazioni (Autorità Agcom).
